If the house is historic in Ormond Beach

Who reviews it: Ormond Beach Historic Landmark Preservation Board (HLPB).

When it applies

  • Demolition of an individually designated building or structure, or a contributing property in a designated historic district (LDC Sec. 2-71).
  • Demolition of a building constructed before January 1, 1950, if the planning director determines it contributes to a historic district's qualities or is a rare architectural style in the city (examples named: Mediterranean Revival, Craftsman Bungalow, Queen Anne, Eastlake, Dutch Colonial Revival, Art Moderne).
  • City page: certificates of appropriateness are required to remove structures from the Lincoln Avenue Overlay District, to demolish a contributing property there, or any structure built before January 1, 1950.

How the review works

  • Planning director refers the permit application to the Board within 10 working days.
  • Board holds a public hearing at least 21 days after referral; owner gets notice at least 10 days before.
  • Board approves, approves with conditions (which may include a delay), or denies.
  • Decision is mailed to the applicant and abutting owners within 10 days; appeal to the City Commission within 30 days, then certiorari to circuit court.
  • A certificate of appropriateness is not required if the chief building official certifies the demolition is required because of an unsafe or dangerous condition.

What the board can ask for

  • After any delay ends without an acceptable alternative, the permit issues on demand only after architectural and historic documentation has been prepared by the applicant and submitted to the city (Sec. 2-71(d)(9)a.2).

Demolition delay: Up to 30 days for a pre-1950 building that is not a designated landmark and not in a designated district; up to six months for a designated landmark or a building in a designated historic district. The Board and city staff seek alternatives during the delay (Sec. 2-71(d)(9)).

Good to know
  • Demolishing without a permit a building built before January 1, 1950, a listed historic building, or a contributing property is subject to the penalties of Sec. 1-9 of the Code, and the chief building official must seek the maximum penalties (Sec. 2-71(g)(2)).
  • Board review criteria for demolition: significance, importance to the district, difficulty of reproduction, last remaining example, definite reuse plans, whether it can be saved from collapse, and whether it can earn a reasonable economic return.
  • Coastal lots: the Coastal Construction Control Line (CCCL) is FDEP's jurisdictional line under s. 161.053, F.S. FDEP's Homeowner's Guide says construction and other activities seaward of the CCCL require a CCCL permit from FDEP unless exempt by rule or law. The guide does not name demolition specifically, so check with the FDEP CCCL program before demolishing a structure seaward of the line.
